Nutro Pet Food Lawsuit

NUTRO DOG FOOD LITIGATION – CLASS ACTION CASE SETTLED IN SAN DIEGO SUPERIOR COURT

On September 11, 2012, the Del Mar Law Group, LLP (led by class action lawyers John Donboli and Sean Slattery) obtained a Final Approval Order and Judgment against The Nutro Company in San Diego
Superior Court. The case alleged that Nutro misled consumers by claiming that its dog food products contained live Bacillus microbials. In fact, the dog food products at issue were sold with a “Guaranteed Analysis” label pertaining to the health-promoting, Bacillus microbials in the dog food products. It is not clear how it was determined the Nutro dog treat did not contain the probiotic stated on the label. However, I did do 2 other posts about Greenies, who are manufactured by Nutro. Isn't everyone tired of the word game they are playing. How many times can a company goof up before customer's say to themselves "hey, this isn't right and I don't want my pet harmed." Companies need to stop pulling the wool over consumers eyes!

Evangers Pet Food Owner, Joel Sher, In The News AGAIN

In 2011, Evangers also received a Warning from the FDA where they didn't find Duck in the Duck pet food or Lamb in the Lamb pet food - Read the warning here - There was never a recall - just an FDA warning to them

                                                                                                                                                                                                                                                                                    A Lincolnwood man who is facing charges of illegally diverting gas and power to his pet food company was hit with more charges of trying to bribe a witness in the case, Cook County prosecutors said Saturday.

Joel Sher, 56, allegedly offered $5,000 to a witness in exchange for changing testimony in a case from 2010 where he is accused of ordering his company employees to divert nearly $2 million worth gas and power lines to his store.

                                                                                                                                                                At the time, prosecutors alleged that Sher ordered employees to use jackhammers to dig through concrete and asphalt and divert gas lines, as part of an elaborate system in which gas flow was diverted before it ever reached the meter.

The Sher family, whose Evanger’s Dog & Cat Food Co. store in Wheeling was once featured on the Rachael Ray food show, also allegedly diverted electricity by tapping into main power lines on poles outside their plant, according to court papers.

The loss to Nicor Gas was estimated at $1.4 million, while ComEd lost an estimated $328,000 in energy services, officials said.

In 2010, Cook County prosecutors charged Sher, of the 6500 block of North Navajo Avenue, with felony theft and money laundering. His wife, Holly Sher, was charged with the same crimes.

That case is still pending, according to court records.

Joel Sher now faces three new criminal charges, including subornation of perjury, bribery and communicating with a witness, who was not identified in Cook County bond court Saturday.

Sher’s defense attorney declined to comment after the hearing. Sher, who was held in leiu of a $75,000 bond, is scheduled to appear in court on Wednesday.

FOR IMMEDIATE RELEASE - February 21, 2013 - The
U.S. Food and Drug Administration announced today that Kasel Associates
Industries Inc. is recalling all pet treats it manufactured from April 20
through Sept. 19, 2012 due to potential contamination with Salmonella.
Kasel has issued three previous recall notices for specific products
manufactured during this time period.

The move comes after the Colorado Department of Agriculture tested
a retail sample of a Kasel pet treat product and found it to be positive for
Salmonella. Based on FDA’s follow-up inspection at the firm, FDA found
that all of the finished pet treat product samples and 48 out of 87
environmental samples collected during the inspection tested positive for
Salmonella. More than ten different species of Salmonella were
found in the firm’s products and manufacturing facility, indicating multiple
sources of contamination.

While there are no reports of human illness, FDA has received a
small number of complaints of illness in dogs who were exposed to the treats.
Because of the multiple positive tests for Salmonella, and the
production practices and conditions observed at the facility during the
inspection, FDA believes that there is a reasonable probability that pet treat
products manufactured in the facility from April 20, 2012 through September 19,
2012 are contaminated with Salmonella.

Both people and animals can contract Salmonellosis from handling
or eating contaminated products. People handling dry pet treats should
thoroughly wash their hands after having contact with the treats as well as any
surfaces exposed to these products.

Consumers who have any of these products, or who are unsure of the
manufacturing date of their pet treats, should dispose of them in ways that
people and animals, including wild animals, cannot access them, such as placing
them in a securely lidded garbage can.

The Kasel-manufactured products are sold at various retailers,
including Target, Petco, Sam’s Club and Costco. Most of the products have a
two-year shelf life.

All of the products were made in the U.S. This action is not
related to FDA’s ongoing investigation of jerky pet treats made in China.

Salmonella is a public health risk and is one of the most
common causes of foodborne illness. Healthy people infected with
Salmonella may experience some or all of the following symptoms:
nausea, vomiting, diarrhea or bloody diarrhea, abdominal cramping and fever.
Although rare, Salmonella can result in more serious ailments including
arterial infections, endocarditis (inflammation of the lining of the heart),
arthritis, muscle pain, eye irritation and urinary tract symptoms. Consumers
exhibiting these signs after having contact with the products subject to this
recall should contact their health care provider immediately.

Pets with Salmonella infections may become lethargic and
have diarrhea or bloody diarrhea, fever and vomiting. Some pets may experience
only a decreased appetite, fever and abdominal pain. Infected, but otherwise
healthy pets can be carriers and infect other animals or humans. If your pet has
consumed any of the affected product or is experiencing any of these symptoms,
contact your veterinarian immediately.

The elderly, infants and those with impaired immune systems are
more likely to become severely ill from Salmonella infection. The
bacterium can cause serious and sometimes fatal infections in these vulnerable
populations. Most healthy individuals recover from Salmonella
infections within four to seven days without treatment.

As with humans, dogs who are elderly, very young or have impaired
immune systems are more vulnerable to Salmonella infection.

Hy-vee-dog-foodHy-Vee issues voluntary recall of certain dog food products
Routine testing identifies higher-than-normal contaminant levels in select products

WEST DES MOINES, IA – Hy-Vee, Inc. today issued a voluntary recall of certain bags of Hy-Vee dog food due to elevated levels of a chemical contaminant commonly found in corn.

Routine random tests conducted by the Iowa Department of Agriculture indicated higher-than-normal levels of aflatoxin in some samples of Hy-Vee dog food produced at a Kansas City plant operated by Pro-Pet, LLC.

Aflatoxin is a naturally occurring by-product from the growth of Aspergillus flavus and can be harmful to pets if consumed in significant quantities.  Pets which have consumed this product and exhibit symptoms of illness including sluggishness or lethargy combined with a reluctance to eat, vomiting, yellowish tint to the eyes or gums, or diarrhea should consultant a veterinarian.

The recalled products carry three different “Best By” dates and were distributed to Hy-Vee stores in Iowa, Illinois, Missouri, Kansas, Nebraska, South Dakota, Minnesota and Wisconsin between October 26, 2012 and January 11, 2013.

Hy-Vee officials emphasized the recall is voluntary and only conducted as a precautionary measure. No illnesses have been reported in dogs consuming the product, and the product does not pose a health risk to humans handling it. Hy-Vee officials have also removed all potentially affected products from Hy-Vee stores.

No human or pet illnesses have been reported to-date. The recall notification is being issued based on a recall letter dated February 11, 2013 from Specialty Commodities, Inc. The above-referenced Kaytee
products were originally manufactured as early as June 12, 2012. While Kaytee  has not had any positive Salmonella results on finished product to suggest possible contamination, we are initiating this recall in accordance with FDA guidelines. Kaytee is taking immediate action to remove the potentially affected product from all retail stores and distribution centers.

Salmonella can affect animals eating the products and there is a risk to humans from handling contaminated pet products. Pet owners should thoroughly wash their hands after having contact with these products and clean any surfaces that were exposed.

Healthy persons exposed to Salmonella should monitor themselves for some or all of the following symptoms: nausea, vomit, diarrhea or bloody diarrhea, abdominal cramping, and fever. In rare
circumstances, infection with Salmonella can result in more serious ailments, including arterial infections, endocarditis, arthritis, muscle pain, eye irritation, and urinary track symptoms. Consumers exhibiting these symptoms after having contact with these products should contact their physician or
healthcare provider.

Pets with Salmonella infections may be lethargic and have diarrhea or bloody diarrhea, fever, and vomiting. Some pets will have only decreased appetite, fever and abdominal pain. Infection but
otherwise healthy pets can be carriers and infect other animals or humans. If your pet has consumed the recalled product(s) and has these symptoms, please contact your veterinarian.

Recalled products were distributed to retailers and distributors in the states of Arizona, Arkansas, California, Florida, Georgia, Idaho, Illinois, Iowa, Michigan, Minnesota, Missouri, Montana, New Jersey, New York, North Carolina, Oklahoma, Ohio, Pennsylvania, Puerto Rico, Tennessee, Texas, Vermont, Virginia, Washington, and Wisconsin; and, into the countries of Canada, China, Guam, Japan, Korea, Kuwait, Pakistan, Singapore, and the UAE.

Consumers who have purchased the above-referenced Kaytee products with the referenced "Best Before" dates are urged to contact Kaytee Customer Service representatives.

A letter and instructions will be forwarded to all Kaytee customers. Kaytee Customer Service
representatives and company veterinarians are responding to inquires through the
1-800-Kaytee1 (800 529-8331) phone number and will answer any questions
regarding pets that have been fed the product. Pet owners can also visit the

Honest Kitchen Recalls Thrive, Verve and Zeal Pet Food In US and Canada

1. Why are you announcing this recall?
We are voluntarily recalling five lots of our Thrive, Verve and Zeal pet food products produced between August and November 2012 and sold nationwide in the US and Canada via retail stores, mail order and online after August 2012 because they have the potential to be contaminated with Salmonella. We are taking this action after learning that one of our raw ingredients suppliers has recalled a batch of human-grade parsley that many contain Salmonella. The batch of parsley was
shipped to us in 2012 and used in the production of five lots of finished Honest Kitchen products.

We regularly test for Salmonella and other pathogens as part of our quality control process and have
not received any reports of illness associated with these lots of products. Nonetheless, we are proceeding with this recall in order to ensure the full safety and quality of our products.

3. Are my pets at risk if I fed them the recalled products?
We regularly test for Salmonella and other pathogens as part of our quality control process and have not received any reports of illness associated with these lots of products. Nonetheless, we are proceeding with this action in order to ensure the full safety and quality of our products.

4. What should I do if I have the recalled product?
If you have possession of recalled lots of Honest Kitchen Verve, Zeal or Thrive products, please follow these instructions:
• Stop feeding the products to your pets
• Remove the UPC (bar code) and lot code from the packaging. Lot codes are located on the top of product boxes either adjacent to or opposite the UPC.
• Discard the contents in a covered trash receptacle.
• Submit for a replacement or full refund of the MSRP of the affected products plus $1 to cover postage, by mailing the UPC and lot code along with a completed Reimbursement Form to The Honest Kitchen, 145 14th Street, San Diego, Calif. 92101, Attn: Reimbursements. All refunds will be
processed within five business days (plus postage time).

5. Can I continue to feed my pet the recalled products if they do not appear ill?
No. We strongly advise you to stop feeding the products to your pets and follow the instructions in Question 4 to discard the product and submit for a refund.

6. Why are you recalling these products if none have tested positive for Salmonella?
We are committed to providing the highest-quality human-grade food available to our customers’ pets. While our quality control tests did not find evidence of Salmonella in any of our finished
products, we are accountable for everything we make, and are recalling these products to ensure the safety and integrity of our products.

7. How do you select your suppliers?

We work closely with each of our suppliers to carefully source our human grade ingredients. We choose suppliers who care, because we care.

Many of our ingredients are carefully sourced from farms in their ‘native’ countries, such as Fair-trade Organic Quinoa from Bolivia, Sweet Potatoes from their native Peru and Bananas from the Philippines. We’re also a proud member of Green America, whose mission is to harness economic power—the strength of consumers, investors, businesses, and the marketplace—to create a socially just and environmentally sustainable society.

8. Are any other lots of these products affected? Are any other The Honest Kitchen products affected?
No other batches, production dates or other Honest Kitchen products are affected by this recall.
Every pound of parsley delivered by our raw ingredients supplier has been accounted for and was not used in the production of any other lots or products.

9. What quality control processes do you have in place to ensure the safety of your products?
We work closely with each of our suppliers to carefully source our human grade ingredients. Our finished products are made in a human food facility and held to the same high quality control
standards as human food products. And, humans taste the products we make as part of our quality control and R&D processes.

As you may know, Salmonella can appear in many human foods, from pistachios to mangoes, but it trends particularly high in meats, eggs and leafy greens such as spinach, lettuce and herbs. To further protect you from the risks Salmonella can pose, we’re adding additional steps to our quality control process:
• Al dehydrated leafy greens (parsley, basil, dandelion, spinach and alfalfa) will be steamed, to eliminate pathogens while maintaining our commitment to very gentle production that retains and protects the nutrients that nature provides.
• We will conduct additional tests for pathogens on all leafy greens when they arrive at our manufacturing facility.
• We are no longer purchasing any ingredients from the supplier that provided the parsley being recalled.

We are committed to continually evolving and adapting our procedures to prevent problems like this from occurring in the future.

Nutri-Vet, LLC. of Boise, ID is voluntarily recalling its Nutri-Vet and NutriPet Chicken Jerky Products because they may be contaminated with Salmonella. Salmonella can sicken animals that eat these products and humans are at risk for Salmonella poisoning from handling contaminated pet products, especially if they have not thoroughly washed their hands after having contact with the pet products or any surfaces exposed to these products.

Healthy people infected with Salmonella should monitor themselves for some or all of the following symptoms: nausea, vomiting, diarrhea or bloody diarrhea, abdominal cramping and fever. Rarely, Salmonella can result in more serious ailments, including arterial infections, endocarditis, arthritis, muscle pain, eye irritation, and urinary tract symptoms. Consumers exhibiting these symptoms
after having contact with this product should contact their healthcare providers.

Pets with Salmonella infections may be lethargic and have diarrhea or bloody diarrhea, fever, and vomiting. Some pets will have only decreased appetite, fever and abdominal pain. Infected but otherwise healthy pets can be carriers and infect other animals or humans. If your pet has consumed the recalled product and has any of these signs, please contact your veterinarian.

Nutri-Vet is recalling the lot numbers below because the manufacturer of an ingredient used in the products below informed us of the possibility of Salmonella presence at the manufacturing facility, although no positive test results have been found on Nutri-Vet or NutriPet products to date.

The recalled Chicken Jerky Treats were distributed nationwide through online sales and in retail stores from April 2012 through February 2013 with Best By Dates ranging from April 20, 2014, through October 3, 2014.

of the ingredient supplied to Nutri-Vet while FDA and the manufacturer continue
investigating as to the source of the potential contamination. No other products
made by Nutri-Vet, LLC are included in the recall.

Consumers who have purchased Nutri-Vet and NutriPet Chicken Jerky Products
are urged to stop feeding them to pets and return the product to the place of

NATURE’S VARIETY ISSUES VOLUNTARY RECALL OF ONE BATCH
OF INSTINCT® RAW ORGANIC CHICKEN FORMULA FOR DOGS & CATS
DUE TO POSSIBLE HEALTH RISK

Natures-variety-raw-organic-chicken-160Nature’s Variety has announced a voluntary recall of one batch of Instinct® Raw Organic Chicken Formula with a "Best if Used By" date of 10/04/13. This action is being taken because pieces of clear plastic may be found in some bags and could cause a potential choking risk to pets.  The source of plastic has been identified and the issue has been resolved.

The affected product is strictly limited to a single batch of Organic Chicken Formula with the “Best if Used By” date of 10/04/13.  This includes:

• UPC# 7 69949 60137 1 – Instinct Raw Organic Chicken Formula medallions, 3 lbs. bag
• UPC# 7 69949 70137 8 – Instinct Raw Organic Chicken Formula medallions, 27 lbs. case
• UPC# 7 69949 60127 2 – Instinct Raw Organic Chicken Formula patties, 6 lbs. bag
• UPC# 7 69949 70127 9 – Instinct Raw Organic Chicken Formula patties, 36 lbs. case

The "Best if Used By" date is located on the back of the package below the "Contact Us" section.  The affected product was distributed through retail stores and internet sales in the United States and Canada.  No other products were impacted.

Nature’s Variety became aware of a potential issue after receiving a consumer complaint.  The source of the issue was identified and resolved.  To date, there have been no reports of harm to dogs or cats.

Consumers feeding the affected product should discontinue use and monitor their pet’s health, and contact their veterinarian if they have concerns.  Consumers who have purchased one of the above products can obtain a full refund or exchange by either returning the product in its original packaging or bringing a proof of purchase back to their retailer.

Degenerative Joint Disease in Cats

Degenerative Joint Disease (DJD) is a progressive, long term degeneration of the cartilage of the joints. DJD is common in older cats although many show no symptoms of lameness. Instead, cats frequently will have difficulty grooming, jumping up or using the litter box. Some cats appear stiff when they walk, become very grouchy or do not wish to be touched.

Cat-outdoorsDJD can occur secondary to obesity, trauma, abnormal wear on the joints,or congenital joint diseases like hip dysplasia. In many cases, aged cats have simply worn out their joints from years of jumping, chasing and stalking prey!

Diagnosis of DJD in cats may be suspected based on clinical symptoms but needs to be confirmed by a veterinarian. Radiographs may reveal arthritis and a manual examination of the joints may show decreased range of motion, swelling or pain in the joints.

Medical therapy treats the symptoms of DJD but does not cure it. Sometimes surgery is necessary if the cat is in extreme pain from the arthritic joint. Physical therapy can also be helpful for these cats. Exercise therapy, massage, chiropractic, hot or cold packs and even swimming can greatly improve the quality of life for these cats.

Anti-inflammatory drugs such as Meloxicam can be used in cats but they need to be used with caution. Many cats are susceptible to drugs in this class so they are best avoided if possible. Natural therapies such as glucosamine/chondroitin supplements and herbs have proven effective. Devil's claw, Yucca, and turmeric are useful herbs for this condition, but generally work better in combination. Herbal formulae such as Agile Joints work very well in these patients. Diets containing omega 3 fatty acids and digestive enzymes are also good for these kitties.

Acupuncture, if tolerated by the cat,works well for this condition. Most of my feline patients do tolerate acupuncture quite well and have excellent results from this treatment. Since excess weight puts a lot of stress on the joints and accelerates DJD, it is important to try to prevent obesity in the cat. With exercise, a healthy diet and the right herbs and supplements, your older cat can live a long, pain free life even if he does suffer from osteoarthritis.
